Do I have a case?

It depends on three main factors: liability, causation and damages. Liability determines who is responsible or at fault for the accident. How much is my case worth?

How long will it take to resolve my case?

If the case is settled without a lawsuit with an insurance company it may be resolved within six months. If the case can not be settled and a lawsuit is filed it may take one to two years to resolve. Every case is unique and has different facts and circumstances that may affect how long it will take to successfully resolve.

How much will it cost me to pursue my case?

If there is no recovery then there is no cost charged to the client. Any costs incurred will be paid by the attorney in evaluating your case and if the attorney is successful in obtaining a recovery on your behalf the attorney will be reimbursed his costs out of the recovery from the insurance company. If your case is settled without a lawsuit your costs may be less than five hundred dollars or if a lawsuit is filed your costs could range from a few thousand dollars to tens of thousands of dollars depending on the complexity of your case.

How does my attorney get paid for successfully handling my case?

Your attorney will handle your case on a contingency fee and cost basis which means he will only collect his fees and costs if successful in obtaining a recovery for you. Generally an attorney will charge you 33 1/3% of the total recovery for attorney fees if settled without a lawsuit and will charge 40% of the total recovery for attorney fees if a lawsuit is filed. If your attorney is not successful in obtaining a recovery for you then you would not owe him any attorney fees or costs.
